1. Terms and Conditions

This document is an electronic record in terms of Information Technology Act, 2000 and rules thereunder as applicable and the amended provisions pertaining to electronic records in various statutes as amended by the Information Technology Act, 2000. This electronic record is generated by a computer system and does not require any physical or digital signatures.

This document is published in accordance with the provisions of Rule 3 (1) of the Information Technology (Intermediaries Guidelines) Rules, 2011 that require publishing the rules and regulations, privacy policy and Terms of Use for access or usage of www.a2pay.co.in website.

This Merchant Agreement (“Agreement”) is a legal agreement between you (“you”, “your”) and A2 NEXUS CORP PRIVATE LIMITED (“A2Pay”, “we”, “our” or “us”) governing your use of A2Pay’s services whereby A2Pay shall provide aggregate payment gateway solutions to you for selling Products (as defined below) and/or collecting money for a specified purpose (together, the “A2Pay Services”).

When you use A2Pay.co.in provided by us, you will be subject to the rules, guidelines, policies, terms, and conditions applicable to such service, and they shall be deemed to be incorporated into this Agreement and shall be considered as part and parcel of this Agreement. The Privacy Policy forms a part of this Agreement. We reserve the right, at our sole discretion, to change, modify, add or remove portions of this Agreement at any time without any prior written notice to you. It is your responsibility to review this Agreement periodically for updates / changes. Your continued use of A2Pay Services following the posting of changes will mean that you accept and agree to the revisions.

This is an important document which you must consider carefully when choosing whether to use A2Pay Services at any time. Please read the terms of this Agreement carefully before agreeing to it. This Agreement also highlights certain risks on using the A2Pay Services together with guidance on how online payments through A2Pay can be facilitated.

You are solely responsible for understanding and complying with any and all laws, rules and regulations of your specific jurisdiction that may be applicable to you in connection with your business and your use of the A2Pay Services.

BY CLICKING THE ACCEPTANCE BUTTON OR ACCESSING, USING OR INSTALLING ANY PART OF THE SERVICE, YOU EXPRESSLY AGREE TO AND CONSENT TO BEING IRREVOCABLY BOUND BY THIS AGREEMENT AND ALL OF THE TERMS SET OUT HEREIN.

A2PAY SHALL BE DEEMED TO HAVE ACCEPTED THIS AGREEMENT AND THE CONTRACT SHALL ONLY BE CONSIDERED TO BE DULY EXECUTED, VALID AND BINDING AFTER THE RECEIPT OF THE REQUIRED INFORMATION FROM YOU, DUE VERIFICATION OF THE SAME BY A2PAY AND A VERIFICATION OF THE CONTRACT BEING SENT BY A2PAY TO YOU.

THE CONTRACT SHALL BE DEEMED TO HAVE BEEN RECEIVED, ACCEPTED AND FORMED AT Opposite KVS Public School,

Sambhal – 244304, Uttar Pradesh, INDIA.

2. Privacy Policy

This privacy policy (“PRIVACY POLICY”) applies to your use of the website of A2Pay hosted at a2pay.co.in, the Services (as defined under the A2Pay “Terms of Use”) and A2Pay applications on mobile platforms (Android, Windows Phone, iOS etc.) (collectively (“A2PAY” or “WEBSITE”)).

The terms “WE”, “OUR” and “US” refer to A2Pay and the terms “YOU”, “YOUR” and “USER” refer to you, as a user of A2Pay. The term “PERSONAL INFORMATION” means information that you provide to us which personally identifies you.

The Customer needs to send the following details for all complaints:

• Transaction Date & Time

• Product Name

• Transaction ID and Amount

• Details of complaint

We have implemented reasonable security practices. However, due to inherent internet risks, A2Pay cannot guarantee absolute security.

3. Refund Policy

By accepting A2Pay Services, you agree to process returns, refunds and adjustments in accordance with this Agreement, Acquiring Banks’ instructions and Card Association Rules. No refund shall be processed by A2Pay after 180 days from the date of transaction.

You shall:

• Maintain a fair refund and cancellation policy

• Disclose refund terms to Buyers

• Not issue cash refunds unless required by law

Chargebacks may still occur if refund policies are unsatisfactory to the Customer.

4. User Policy

The User Online Registration Form, User E-Sign Consent, User Terms & Conditions along with the Privacy Policy and Chargeback Policy (collectively “Agreement”) govern the use of A2Pay services.

This Agreement is between the User and A2 NEXUS CORP PRIVATE LIMITED (“A2Pay”, “we”, “our”, “us”).

Users are responsible for compliance with applicable laws while using A2Pay Services.

5. Copyrights

We record information relating to your use of A2Pay, including IP address, browser type, and usage data. This data is used for security and service improvement.

All intellectual property rights related to the Website belong exclusively to A2Pay. No license or ownership is transferred to the User.

A2Pay disclaims all warranties regarding the Website content, accuracy, or availability.

6. Cookies

A2Pay uses session and persistent cookies to improve service quality. Users may disable cookies through browser settings, though some services may not function properly.

Third-party tools may collect anonymous usage data. No Personal Information is shared.

7. Account & Billing

When creating an account with A2Pay, Users may be required to submit Personal and Sensitive Personal Information, including KYC and financial data as per RBI regulations.

A2Pay uses this information strictly for service delivery and compliance.

Users may opt to erase their data, upon which A2Pay shall delete stored information from its servers.
